Court Dismisses Lawsuit Town Filed In Attempt To Block Nursing Home

Rocky Hill residents and lawmakers vow to fight on.


A Superior Court judge has dismissed a Town of Rocky Hill lawsuit attempting to prevent a state nursing home from opening at 60 West Street, Town Attorney Morris Borea told a group of residents at the Rocky Hill Community Center Wednesday evening.

According to a report on Fox 61, Borea told the people gathered that the town learned the lawsuit was dismissed at about 5:30. That sent audible gasps through the crowd. 

The proposed West Street nursing home would house terminally ill and incapacitated state prisoners.

In an interview with Fox 61, Borea said, "They have opened Pandora's Box. We think denying us the right to have our day in court is the most egregious thing the court has done. We believe that an appellate court would agree with our stance. Thats the American way, everybody get's their day in court but we didn't get that chance." 

Resident Leslie Kerz told Fox 61 of her disappointment.

"The people we trust to follow regulations, to follow Planning&Zoning, to keep our safety at the forefront have let us down," Kerz said. 

State Rep. Antonio Guerrera vowed to not let this defeat stop him from fighting.

"We might keep getting the rug pulled out from under us but we're going to keep running to let them know and clearly understand how disappointed we are as the town of Rocky Hill." Guerrera told Fox 61. 

According to the television report on 60 West St., the court dismissed the suit by the Town of Rocky Hill because it was a state project and it superceded the town's suit due to "Sovereign Immunity."
